Who is responsible for the smog check?
According to the DMV, the seller must provide a valid smog certification when a vehicle is sold. If you are selling, get the smog check done before you hand over the title. If you are buying, ask the seller for a current certificate. You will need it to register the vehicle in your name.
How the 90-day rule affects a sale
A passing smog certificate is valid for 90 days, so timing matters. If the car takes weeks or months to sell, get the smog check when you have a serious buyer, or be ready to test again. See how long a smog check is good for.
Newer cars: the 4-year rule
A gasoline vehicle that is less than 4 model years old does not need a smog check at change of ownership. Instead, the buyer pays a smog transfer fee to the DMV. This rule is about ownership changes; the separate 8-year rule covers registration renewals. Our exempt vehicles guide explains both.
Family transfers and gifts
Moving a vehicle between close family members generally does not require a smog check. But the DMV says that if a relative bought a car for you and never put it in their own name, a smog inspection is required. When a family transfer is involved, ask the DMV what applies.
Buying a car from out of state
